PRIORITY EXAMINATION FOR STARTUPS’ PATENT APPLICATIONS COMES INTO FORCE

In the past five years, the number of companies categorized as startups has more than tripled in Brazil, causing an increase in the development of innovation and the improvement of products and services.

In this regard, aiming at encouraging the developments of such companies, as well as the consolidation thereof on the market and the improvement in their conditions of negotiation (by obtaining a patent, for example), it came into force the priority examination program for startups, offered by the Brazilian Patent and Trademark Office (BPTO).

Naturally, to benefit from the fast-track, the patent applicant must prove the qualification as a startup company, in accordance with Complementary Law No. 167/2019.
